Before the legal stuff — here's what matters:
✓ What's In? is a marketplace. We connect buyers and sellers. We're not the seller.
✓ Payments go directly to sellers via Stripe — secured by Stripe's infrastructure.
✓ Listing is free! Sellers pay 7.5% platform fee + Stripe processing (2.65% + $0.30) only when items sell. Buyers pay exactly what's listed — no hidden fees.
✓ Scammers get banned. We use real ID checks.
✓ We collect some personal info. Read our Privacy Policy to see exactly what and why.
✓ NZ law applies. If you're outside NZ, check the country-specific addendum.

What's In? ("we", "us", "our", "the Platform") is an online marketplace connecting private sellers with buyers across New Zealand and, in future, additional countries.
What's In? is a marketplace, not a seller. We facilitate transactions between independent buyers and sellers. We are not a party to any contract of sale between a buyer and seller.

By creating an account, browsing listings, listing items for sale, or making a purchase on What's In?, you agree to these Terms & Conditions in full.
If you do not agree, do not use What's In?
You must be 18 years or older to use What's In? By creating an account you confirm you are 18 or older.
You must provide accurate, complete, and current information when creating an account.
Each person may hold one active account. Creating multiple accounts to circumvent suspensions or bans is a serious breach of these Terms.
You are responsible for maintaining the security of your account and password. Notify us immediately at support@whatsin.co.nz if you suspect unauthorised access.
We may suspend or terminate your account at our discretion if you breach these Terms, engage in fraudulent activity, or behave in a way that harms other users or the platform.
When you click "Buy Now" and complete checkout, you enter into a binding contract of sale with the seller. What's In? is not a party to this contract.
Your payment is processed securely by Stripe and transferred directly to the seller's verified Stripe account. All sellers are identity-verified before receiving payouts.
You may cancel an order within 1 hour of purchase, provided the seller has not yet marked the item as shipped. After shipping, orders cannot be cancelled — raise a dispute instead.
If you have an issue with your order, raise a dispute within 14 days of the seller's marked dispatch date. Disputes are reviewed by What's In? staff and resolved at our discretion.
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 (NZ) or the Fair Trading Act 1986 (NZ) where they apply.
You may list personal items for sale. You must own the item, accurately describe its condition, use genuine photos, and not list prohibited items.
Listing is free. Sellers pay no upfront fees. Only when an item sells, sellers pay a 7.5% platform fee plus Stripe's standard processing fee (2.65% + $0.30 NZD per transaction), deducted automatically at payout. Extra photos are $0.50 NZD each (maximum $2.00 NZD per listing). Buyers pay exactly the listed price — no buyer fees or hidden charges. Standard payouts take 2–5 business days. Instant payouts are available via Stripe Express for additional fees. Fees may change with 30 days notice.
Tracked shipping protects your payment in all non-receipt disputes. If you send untracked, you explicitly acknowledge that: if a buyer raises a non-receipt claim, What's In? will default to refunding the buyer. Your payment is not protected. This acknowledgement is recorded on your account at the time of listing.
You must dispatch sold items within 5 business days from sale. Failure may result in automatic cancellation, full refund to buyer, and a strike on your account.
Payouts are processed via Stripe Connect to your nominated NZ bank account. Stripe requires KYC verification before your first payout. Payouts are processed within 1–2 business days of fund release.
What's In? uses AI to suggest prices based on identified items and comparable NZ market data. These suggestions are estimates only. We do not guarantee accuracy. Sellers set their own prices and are free to accept, modify, or ignore AI suggestions.
Price comparisons may reference publicly available Trade Me sold listing data. What's In? is not affiliated with Trade Me.
Stolen goods · Counterfeit or replica branded goods · Items subject to legal restrictions in NZ · Weapons/firearms (unless legally licensed — contact us) · Controlled substances · Items infringing intellectual property rights.
Products posing safety risks without disclosure · Recalled products · Items with dangerous lead paint, asbestos, or other hazardous materials without disclosure.
Antiques requiring export permits · Native wildlife products · Medical devices · Alcohol (requires special approval).
Listing prohibited items will result in immediate removal and may result in account suspension or referral to NZ Police.
All payments are processed by Stripe, Inc. By using What's In?, you also agree to Stripe's Terms of Service. What's In? does not store credit card or full bank account numbers.
All transactions on the NZ platform are in New Zealand Dollars (NZD).
Sellers are responsible for any tax obligations arising from their sales, including GST if they are a GST-registered trader. What's In? does not provide tax advice.
Sellers must complete Stripe's Know Your Customer (KYC) verification before receiving any payout. Stripe collects and verifies this information.
Any buyer who raises a non-receipt dispute is required to complete identity verification via Stripe Identity before their dispute is processed. This is a fraud prevention measure designed to protect sellers.
Providing false identity information is a serious criminal offence in New Zealand under the Crimes Act 1961. We will report verified identity fraud to NZ Police.
What's In? operates a structured dispute resolution process as described in our Safety Policy. Our decision in disputes is final within the platform, though nothing limits your legal rights outside the platform.
All disputes must be raised in good faith. Raising false or frivolous disputes is a breach of these Terms and will result in strikes and potential suspension.
Disputes must be raised within 14 days of the seller's marked dispatch date. We cannot process disputes raised after this window — funds transferred to the seller at this point cannot be reversed by What's In?

Suspended users may appeal by contacting support@whatsin.co.nz within 14 days. We aim to respond within 5 business days.
You agree not to: harass or abuse other users · share others' personal information without consent · use the platform for illegal purposes · circumvent safety, payment, or verification systems · scrape or reproduce platform content without permission · introduce malware · impersonate other users or staff · coordinate price manipulation · conduct transactions off-platform to avoid fees.
All What's In? branding, design, copy, Charlie mascot, and platform code is owned by the Company or its licensors (including SaaSy Cookies). By uploading content, you grant us a non-exclusive, royalty-free, worldwide licence to display and use that content for operating the platform.
We collect, use, and store personal information in accordance with our Privacy Policy and the New Zealand Privacy Act 2020.
To the maximum extent permitted by law, What's In? is not liable for: the quality, safety, or legality of items listed · actions or omissions of buyers or sellers · loss or damage arising from transactions between users · service interruptions or technical failures · any indirect, consequential, or special loss.
Our total liability to you in any circumstances is limited to the value of the transaction in dispute.
We may update these Terms from time to time. We will notify you of material changes by email, with minimum 14 days notice before changes take effect. Continued use of What's In? after changes take effect constitutes acceptance of the new Terms.
These Terms are governed by the laws of New Zealand. Any disputes are subject to the jurisdiction of the New Zealand courts.
An Australia-specific addendum incorporating Australian Consumer Law will be published at /legal/terms/au when the Australian market launches.
